1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "you") and Rhino Coatings, LLC ("Rhino Coatings," "we," "our," or "us"), a limited liability company organized under the laws of the State of Idaho.
By accessing or using our website at rhinocoatingsusa.com or rhinocoatingscda.com (the "Site"), submitting a quote request or contact form, calling our business, engaging with our SMS communications, or entering into a service agreement with us, you agree to be bound by these Terms in full. If you do not agree to these Terms, please refrain from using our website or engaging our services.
You represent that you are at least 18 years of age, have the legal capacity to enter into a binding contract, and, if acting on behalf of a business entity, have the authority to bind that entity to these Terms.
We reserve the right to modify these Terms at any time. Material changes will be communicated through website notice or other reasonable means. Continued use of the Site or our services after changes become effective constitutes acceptance of the revised Terms.

3. Quotes & Estimates
Rhino Coatings provides free project estimates and quotes to prospective customers. The following terms govern the quotation process:
Estimates Are Not Binding Contracts
All quotes, estimates, and pricing information provided verbally, via our website, via email, via SMS, or through any other communication channel are estimates only. They are based on information provided by the customer or observed during a preliminary assessment, and are subject to change following a thorough on-site inspection.
On-Site Assessment Required
Final project pricing is confirmed only after an in-person site assessment by a qualified Rhino Coatings representative. Factors that may affect final pricing include, but are not limited to:
- Actual square footage (which may differ from customer-provided measurements)
- Condition of the existing concrete or substrate surface
- Required surface preparation (grinding, shot-blasting, crack repair, moisture mitigation)
- Accessibility and logistical considerations
- Product system selected, number of coats, and finish type
- Site-specific safety or code requirements
Written Agreement Required
No project will commence without a written service agreement signed by both parties. The service agreement will specify the confirmed scope of work, materials, pricing, payment terms, project timeline, and applicable warranty. In the event of a conflict between these Terms and a specific service agreement, the service agreement shall govern.
Quote Expiration
Written quotes are valid for thirty (30) days from the date of issue unless otherwise stated in the quote document. Material price fluctuations, seasonal demand, or availability of crew may necessitate revised pricing after expiration.
Note: Submitting a quote request form on our website does not create a binding contract, guarantee service availability, or commit Rhino Coatings to any specific price or timeline. It initiates a consultation process.
4. SMS Terms of Service

Program Name: Rhino Coatings SMS Alerts

7. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RHINO COATINGS WEBSITE AND ALL INFORMATION, CONTENT, AND MATERIALS PROVIDED THEREIN ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Rhino Coatings expressly disclaims all warranties with respect to the website, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties of title or non-infringement
- Warranties that the website will be error-free, uninterrupted, or free of viruses or other harmful components
- Warranties regarding the accuracy, completeness, or timeliness of any content on the Site
Pricing information, service descriptions, and availability displayed on our website are subject to change without notice and do not constitute a binding offer. Actual service terms are governed solely by your signed service agreement with Rhino Coatings.
Workmanship Warranty
Any warranty relating to the quality of workmanship, materials, or the finished coating system is separate from these Terms and is addressed exclusively in your individual service agreement. The existence, scope, duration, and conditions of any workmanship or product warranty will be specified in writing in that agreement. No warranty is created by any statement made on this website or in verbal communications unless confirmed in a signed service agreement.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RHINO COATINGS, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:
- Your access to or use of (or inability to use) our website
- Any content obtained from or through the website
- Unauthorized access to or alteration of your transmissions or data
- Any reliance on information provided on the website

IN ALL CASES, RHINO COATINGS' TOTAL CUMULATIVE LIABILITY TO YOU ARISING FROM OR RELATING TO THESE TERMS OR THE USE OF OUR WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00), OR THE AMOUNT YOU PAID TO RHINO COATINGS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
This limitation of liability applies regardless of the legal theory under which such damages are sought (contract, tort, strict liability, or otherwise), even if Rhino Coatings has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits Rhino Coatings' liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence.
Note: This limitation applies specifically to the use of our website and digital communications. Liability arising from the physical performance of contracted coating services is governed by your signed service agreement and applicable Idaho law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Rhino Coatings, LLC, and its members, officers, employees, agents, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to the Rhino Coatings website
- Your violation of any provision of these Terms
- Your violation of any applicable law or regulation
- Any content or information you submit to us that is inaccurate, misleading, or infringes upon any third party's rights
- Any dispute between you and a third party related to your use of our services
Rhino Coatings reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with our defense of such claims. You will not settle any matter subject to this indemnification without our prior written consent.
10. Governing Law & Jurisdiction
These Terms of Service, and any disputes arising from or relating to them or to your use of our website or services, shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions.
For any legal proceeding not subject to the arbitration provisions of Section 11, you consent to the exclusive personal jurisdiction of the state and federal courts located in Kootenai County, Idaho, and you waive any objection to the laying of venue in such courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
11. Dispute Resolution
Rhino Coatings is committed to resolving disputes fairly and efficiently. Please follow these steps before pursuing formal legal action.
Step 1: Good Faith Negotiation
If a dispute arises between you and Rhino Coatings relating to these Terms, the website, or any services we provide, both parties agree to first attempt to resolve the dispute through good faith negotiation. You must notify us in writing of your dispute, providing a clear description of the issue and the relief sought. We will respond within thirty (30) days of receiving your written notice. Both parties agree to negotiate in good faith for at least thirty (30) days before proceeding to arbitration.
Step 2: Binding Arbitration
If good faith negotiation fails to resolve the dispute within thirty (30) days (or such extended period as both parties agree to in writing), the dispute shall be submitted to and resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable, which are incorporated herein by reference.
- The arbitration shall be conducted in English, in Kootenai County, Idaho, or via remote hearing at the arbitrator's discretion.
- The arbitrator shall have authority to award any remedy available under Idaho law.
- The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
- Each party shall bear its own arbitration costs and attorneys' fees, unless the arbitrator determines that a party acted in bad faith, in which case the arbitrator may award costs and fees to the prevailing party.
Class Action Waiver
ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU AND RHINO COATINGS WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR CLASS-WIDE ARBITRATION. No arbitration may be consolidated with any other arbitration proceeding without the written consent of all parties.
Small Claims Court Exception
Notwithstanding the foregoing, either party may bring an individual claim in small claims court in Kootenai County, Idaho, if the claim qualifies under that court's jurisdictional limits and rules.
12. Modifications to Terms
Rhino Coatings reserves the right to update, modify, or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Effective Date" at the top of this page.
For material changes — particularly those that affect your rights or our core obligations — we will make reasonable efforts to provide advance notice. This may include a prominent notice on the homepage of our website or direct notification to customers with active accounts in our CRM system.
Your continued use of our website or services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using our website and, where applicable, notify us that you are terminating any ongoing service engagement subject to these Terms.
We encourage you to review these Terms periodically. Archived versions of prior Terms may be requested by contacting us directly.
13. Severability & Waiver
Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any single provision.
No Waiver
No failure or delay by Rhino Coatings in exercising any right, power, or privilege under these Terms shall constitute a waiver of that right, power, or privilege. No single or partial exercise of any right or remedy shall prevent any further exercise of that right or remedy, or of any other right or remedy. A waiver of any provision of these Terms must be in writing signed by an authorized representative of Rhino Coatings to be effective.
14. Entire Agreement
These Terms of Service, together with our Privacy Policy (available at rhinocoatingscda.com/privacy.html), constitute the entire agreement between you and Rhino Coatings with respect to your use of our website and our digital communications, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties relating to the same subject matter.
These Terms do not govern the actual performance of physical coating or restoration services. The terms and conditions applicable to any specific service project are set forth in the written service agreement executed between you and Rhino Coatings prior to the commencement of work. In the event of a conflict between these Terms and a signed service agreement, the service agreement shall control with respect to the physical services covered therein.
No oral representations, promises, or agreements made by any Rhino Coatings employee or representative shall modify or supplement these Terms unless confirmed in writing by an authorized officer of Rhino Coatings, LLC.
